Recently, I’ve been reflecting on my experience as an independent coach within Germany's state-subsidized career programs. Working directly with coachees was deeply fulfilling—I gave them everything I had to help them build real, sustainable perspectives. But behind the scenes, the administrative machinery was riddled with glaring contradictions.
The most absurd issue sits at the intersection of contract law and bureaucratic creep. As a freelancer, my agreement is strictly time-based (Dienstvertrag), paying purely for hourly coaching sessions. Yet the certified training institutes routinely demand extensive, highly detailed final reports for the state employment agency (Jobcenter)—effectively forcing a complex, uncompensated deliverable (Werkvertrag) into a basic hourly rate.
Even worse is the blatant disregard for basic privacy. I was repeatedly expected to email these sensitive reports—full of personal histories and unencrypted real names—across open networks. Under European GDPR laws, that isn't just sloppy; it's a direct legal violation.
I’ve now requested formal, written clarification from the institute regarding administrative compensation and strict data compliance. This isn't about pointing fingers—it's about demanding structural and ethical integrity. If we claim to offer high-quality adult education, we cannot throw basic data privacy and fair contracting out the window the moment bureaucracy becomes inconvenient.
